Derek Michael Chauvin is a white American former police officer who was convicted for the murder of George Floyd in Minneapolis, Minnesota on 25 May 2020. During an arrest made by Chauvin and three other officers, he knelt on George Floyd's neck for eight minutes 46 seconds while Floyd was handcuffed and lying face down on the road. The death set off a series of protests around the world, led by the Black Lives Matter campaign.[1]

Derek Chauvin was fired by the Minneapolis Police Department the day after the incident. He was initially charged with third-degree murder and second-degree manslaughter;[2] a charge of second-degree murder was later added.[3]

At a pre-trial Hearing on 29 June 2020, Chauvin's bail was set at $1.25 million or $1 million under certain conditions, while bail for the three other officers (Kueng, Thao and Lane) was set at $1 million each or $750,000 under certain conditions. Chauvin, 44, and Thao, 34, remain in custody, and Lane, 37, and Kueng, 26, were released on conditional bond. Judge Peter Cahill said they are targeting the dates of 11 September 2020 to hold another hearing and 8 March 2021 to begin trial.[4]

Trial

During the trial the lawyers for Chauvin entered a motion that noted:[5]

  • In 2019 Floyd was engaged in the sale and possession of large quantities of controlled substances.
  • When approached by police on May 6, 2019 he placed drugs in his mouth in an attempt to avoid arrest, and swallowed them.
  • At which time Mr. Floyd disclosed that he “snorts oxycodone daily” in the hospital.
  • In 2007 Floyd was convicted of Aggravated Robbery with a Deadly Weapon for forcibly entering a home to steal drugs and money. In the course of the robbery Mr. Floyd placed a gun on a woman’s abdomen.
