After Smedley Butler exposed the business plot, FDR is believed to have reached a secret agreement not to prosecute (or even publicly name) them, in return for their support of his New Deal policies. One exception to this deal might have been Andrew Mellon - at least FDR made sure he was chased by the Internal Revenue Service.
